How To Dodge A Silver Bullet.

It didn’t take very long for those conniving basterts at the SFA to wipe the NINE IN A ROW smiles from the faces of the Celtic support. Roughly 24 hours,in fact. They have proudly announced that they will not be sending to the Court of Administration of Sport the matter of the awarding to Rangers of a European licence for 2011/12.
The excuses that they have offered include such gems as being advised of costs to do so exceeding six figures while the punishments available are only of £5000 and £10,000. That the terms of the 5WA mean that they can’t deal with the problem themselves. That legal advice suggests little chance of victory.

Well,excuse me butting in here. The questions raised by Resolution 12-the famous recollection of events as compiled by a group of shareholder-backed Celtic supporters-were specifically aimed at holding the SFA to account,not Rangers. It had nothing to do with Rangers as you cannot punish the dead. It was to find out how the SFA managed to facilitate the granting of a European licence to a club which was in breach of the entry conditions regarding tax liabilities,as stipulated by UEFA.
UEFA’s regulations on this are NOT optional. They are mandatory. They MUST be adhered to,but the SFA Licencing Committee decided to ignore them,despite clear evidence of the breach.
In fact,it had been reported in January 2011-over two months before the first cut off date-that Craig Whyte had discovered while doing due diligence on the Ibrox books that there was an undeclared tax liability,and the asking price for the club suddenly dropped from £6m to a quid.
Clear evidence that there was not a disputed bill,but an outstanding one. Yet the licensing committee ignored it. TWICE. And subsequently since. And yesterday the SFA,whose current president is Rod Petrie,declined to investigate its own Licencing Committee’s fraud or failure,that Licencing Committee having been chaired at the time by-Rod Petrie!
This is an obstruction of justice,disguised by the obfuscation and conflation of the Rangers angle and possible punishments. But what of Celtic’s role in all this,for I’m afraid that our club don’t come out of too well either?
Peter Lawwell was well aware that the Rangers application had been wrongly approved. That’s not to suggest that he knew at the time,and it would be wrong to assume without proof. But proof is what he wanted. Proof is what he demanded of the fans behind Res 12. He wanted a silver bullet,and he promised to fire it. The four lads worked diligently to provide him with this,every t crossed and every i dotted.
It did not come cheap,neither in financial terms nor in time consumed. At almost every juncture,they were asked for more. That little higher level of proof,of culpability. That more costly legal opinion,lawyer’s letters,you name it. They were being send down blind alleys,cul de sacs and dead ends. But they stuck to their task,and finally PL had to thank them for their efforts,for the proof provided was irrefutable. The lads had long pleaded with him to send the evidence to UEFA,as such a claim could only be made by a member club or association,but our CEO insisted that it be dealt with by the SFA. Yes,you read that right. He wanted the organisation which had wrongly granted a licence-at the expense of Celtic FC-to investigate itself! And yesterday we saw why that was not the correct decision to make if you really wanted to see justice done.
That is either naive or stupid. Because I wouldn’t like to think it was anything else. But for all my questioning of Peter Lawwell over the last fifteen years or so,I can’t ever remember thinking that he was stupid. So it’s a puzzle,innit? Either way,it is a silver bullet provided and wasted. It would be unbecoming to suggest that he deliberately sent the four lads off on a wild goose chase,at great cost to themselves as I said,knowing that they had no chance of success because he would simply refuse to hand the evidence to UEFA,and would simply allow the SFA to bin the matter. Unbecoming,because there surely can’t be any truth in such a suggestion.
Perhaps our readers might help me out with some ideas,some suggestions for his motivations in all of this. Because the three I’ve mentioned can’t be right. Well,they can’t ALL be right. Actually,none of them can be right,and that is why I have already discounted them. Because that would be an appalling vista. And those words should send a wee shudder through the spines of anyone who knows their history about justice denied.

Corrupt Official, An admirable idea. It would give the Celtic PLC board a get out in terms of the Hampden suits – our hands were forced by a fan base. But this procedure would require the agreement in the first place by the Celtic board. I strongly suspect they would not be minded to go with this.
Did Fergus McCann worry too much about going to a civilian court? Stuff UEFA. They knew and know exactly everything that has gone on and sat back and did nothing! Did they even think about taking the SFA to CAS?
Celtic are not dependant on fan donations for legal fees. Without knowing any details I believe they have a law firm on retainers? Aside from that, Celtic, and especially it’s major shareholder, could easily afford the risk of a six figure legal bill.
They got the silver bullet, but they do not have the gumption to fire the gun I fear.
Does anyone? Just bring it up at the next AGM again? Play the long, long, long game.
The truth will come out in the end. Just like the Royal family whose dirty secrets are kept hidden until about 2 generations after the death of the perpetrator/s.

I was actually a bit pissed off at the board’s statement yesterday,offering a refund with the one hand and putting a moral obligation on everyone to decline.
It’s going to the club,innit. The club is in for refunds of around £6m. Maybe half of the fans will decline. That leaves the other £3m
I suggest that PL realise his own moral obligation. That bonus last year just about covers it.
If on the other hand,people who can afford the hit decide to take the £100-150 each and offer it to the pursuit of a judicial review,that would be just peachy.

Morning Bobby. A very good summary of this whole sordid business. As you will know, I have held the view from the outset that legal action is the only course which may, may, produce a result. How that manifests itself remains to be seen, but I still think that a token case in the small claims court is a possible avenue, with the aim of achieving maximum publicity and, thus, embarrassment to both the SFA and Celtic if it comes to that. Reason: failure of corporate governance and to maintain fiduciary responsibility to shareholders. It would require a legal person to front this to ensure that the small shareholders are able to be represented properly. Any cost would therefore hopefully be minimal, even if the case was lost. I would hope – although not sanguine – that such a prospect might be a catalyst for some appropriate action. It could well be that the best that can be achieved is an admission from the SFA that they were duped, and an acknowledgement that procedures will be rigorously enforced going forward. There is also a possibility of a No Confidence Motion in the Board for the Celtic AGM.

So far as I am aware, all they have done is raise a few banners at Parkhead now and then, but have done little in the way of concrete action. Certainly nothing in the way of the Res 12 ghuys. I think this was the perfect time for the SFA to release this news. Takes the shine off our nine in a row and allows PL to say we have other bigger things to concentrate on. I am heart sorry for the Res 12 guys. No doubt about it in my mind that you have all been played. I would have preferred our board to come out at the time and tell us we couldn’t survive without them. “What ever part of my club depends on the team from ibrox I can do without”
Utter guff. Our board think we can’t survive without them yet we have all spoken recently about the 80s and how much we enjoyed the football. Well they were shit then and the Scottish game was healthier. But there’s the rub. For our board it’s not about the Scottish game. It’s about their executive salaries, and keeping the peasants in line to ensure the money keeps rolling in.
It’s now a case of whether as individuals we are prepared to swallow this to be able to keep going to celtic Park. Plenty I know have stopped already but my personal opinion is and always has been that the majority of the support don’t care about res 12 and just like going to the football.
Don’t think for one minute I condone the cheating but the facts of the matter are we cannot survive in this league without them

Does anyone else think that the Celtic/Sevco duopoly lessens the chance of other Scottish clubs gaining supporters?
No incentive for youngsters to follow a team who are merely there to prop up the big two.
Also a more fair and competitive league would be a better proposition for tv and advertising rather than the outdated fare served now.

Read again what ATOB says about the 1980s. Before Souness came along and English teams were not allowed to play in Europe, Rangers were nobodies. Crowds on a par with St. Mirren etc. We survived.
What about when sevco were in the lower leagues? Did we go bust? Sure crowds were down but I could live with that. Some say it was partially the R. Deila effect as well!
We might have a reduced income but so what. I’d rather that.

Sky/bt tv revenue would drop severely. The knock on effect would not only lessen our income, it would cripple it. Say goodbye at that point to signing decent players and so on. Qualifying for latter stages of Europe gone also. Snowball effect would be goodbye to big sponsors and having to deal with the like of Castore. Sky/bt and any other would have to be convinced to televise Celtic winning the league forever more with no chance of a challenge. Crowd numbers drop making it even more less attractive. Unless we can find a route out of this league we can’t survive AS WE ARE without them

Some good points in there. I suppose it depends on what your ambitions for Celtic are. For example is it your dream for Celtic to be the Scottish equivalent of Man. Utd? Huge broadcasting deal, sign big money players, massive sponsorship?
Mine’s is more modest. Home grown players. Good broadcasting deals like many smaller countries in Europe and Scandinavia, better than we get from Sky/BT. A return to the days when ourselves, Aberdeen & Dundee Utd. were still a force in Europe. Despite our small country status. I can live without our CEO being one of the best paid in British football.
